The HOMBRE web site producers make no representation that this site does not contain computer viruses or other harmful components. The HOMBRE website producers accept no responsibility for transmitting or otherwise passing viruses to users' computers whether by negligence or howsoever caused. Permission to use Documents

Permission to use HOMBRE web site producers' documents (such as papers, reports, training materials) from the HOMBRE web site is limited to downloading and making one file copy and one hard copy for the user's own research or private study. The aforementioned permission does not extent to copying third party documents (or any other information) accessed via links which appear on this site. The web site contains areas where Information can be freely posted by users who submit a properly completed registration form. Only users registered on the "Who does what" directory can post information to the HOMBRE web site.

Indemnities

In the event of any claim being made against r3 Environmental Technology Ltd or against any members of the HOMBRE project team or supplier projects as a result of breach of these terms and conditions by a user, the user undertakes to fully indemnify r3 Environmental Technology Ltd or any members of the HOMBRE project team or supplier projects against all actions, claims, proceedings, damages and costs arising from or incurred by reason of a user's breach of these terms and conditions.

Sharing information

HOMBRE web site producers, details of whom can be found at the top of these terms and conditions may disclose your information to each other.

The HOMBRE web site producers share your information amongst themselves and may provide your information to carefully selected third parties working with HOMBRE, including the European Commission, to further the purposes of the HOMBRE project.

The HOMBRE web site producers will not sell, rent or trade any of the personal information you submit to us. The HOMBRE web site producers are not responsible for the privacy practices or the content of any web sites which may be accessed through a link on HOMBRE's site.

If the assets of any incorporated or unincorporated HOMBRE web site producer's business are acquired by a third party the HOMBRE web site producers may transfer the data they hold to that third party as well as the relevant party's advisors.

Where a third party seeks disclosure of your personal information for legal reasons you agree that we may disclose your information to such third party.

Security

The HOMBRE web site producers are committed to the security of the personal information you submit to us and we have adopted appropriate security procedures to protect the personal data under our control against loss, misuse, unauthorised access, unlawful processing or alteration. The steps we have taken include ensuring the reliability of those in the HOMBRE project who have access to personal data.

It is the registered users' responsibility to ensure that their passwords are kept secure in order to protect against unauthorised access to the message board or other interactive parts of the site. Registered users will be held responsible for unauthorised access and any related claims, losses, costs or liability that the HOMBRE web site producers may be subject to as a result.

Your consent

By submitting your information you consent to the use of your personal information as set out in this policy. If we change our privacy policy we will place a notice on this page of the site, so that you will be aware of the information we collect about you and how we use it at all times. Continued use of the site will signify that you agree to such changes.

Owing to the global nature of the internet the information that you have provided may be transferred to countries outside the European Economic Area that have lower levels of protection in place regarding your data and its use. By submitting your information you consent to these transfers.

Users of this site represent and warrant that they are at least 18 years of age and that all information that they submit is true and accurate. If users are acting as an agent they represent and warrant that they are duly authorised to legally bind the principal entity or person to all terms and conditions relating to use of this site and that you have made the entity or person you are acting for aware of them.

Not withstanding the foregoing, none of the exclusions and limitations in these terms and conditions are intended to limit any rights you may have as a consumer under local law or other statutory rights which may not be excluded nor in any way to exclude or limit the HOMBRE web site producers liability to you for fraudulent misrepresentation or death or personal injury resulting from our negligence.

HOMBRE does not send out SPAM, (sometimes known as unsolicited emails), nor are our servers being used to send out SPAM. SPAM attributed to HOMBRE.org or HOMBRE.info originates from viruses such as W32.Sobig.F which are mass-mailing worms that send themselves to all the email addresses that they find on a host's system. These emails typically use fake FROM addresses. These addresses are arbitrarily picked from the internet and unfortunately they occasionally use the domains HOMBRE.org or HOMBRE.info.

Commercial bulk e-mail organisations (spammers) also use fake FROM address in order to circumvent anti-spam software.

By using this site or submitting your email addresses users accept that there is a possibility that users may receive SPAM, and that at present there is nothing HOMBRE or its ISP can do about this. Users further agree not use any information posted on the web site to send SPAM.

HOMBRE web site producers reserve the right to amend these terms and conditions at any time. All such changes shall take effect once they have been posted on the web site and users will have be deemed to have accepted any such changes by their use of the web site from such time.

This site is created and controlled by r3 Environmental Technology Ltd in England on behalf of the HOMBRE project team and the laws of England shall apply to the Terms of Use and any disputes arising in connection with the use of this web site. All disputes arising in connection with this web site shall be submitted to the exclusive jurisdiction of the English Courts.
